Why were BNS and BNSS introduced in place of old CRPC & IPC and what are the main changes?

          In this blog we will understand why there was a need to replace the archaic CRPC and IPC and what are the main changes in BNS and BNSS that will make Indian legal system more effective and modern.

The Indian legal system has two important laws, the Indian Penal Code (IPC) and the Code of Criminal Procedure (CRPC) , which have been governing crime and the judicial process for a long time. Although these laws were made in the late 19th century, there was a need to change these laws keeping in mind today's contemporary society and technological changes. Keeping this need in mind, BNS (Bharatiya Nyay Sanhita) and BNSS (Bharatiya Nagrik Suraksha Sanhita ) have been introduced.

 Why was there a need to change the old CRPC and IPC?

  1. Keeping pace with societal and technological changes:-  IPC and CRPC were enacted in 1860, when technological and social structures had changed very little compared to today. In today's time, new issues like internet, cyber crimes, digital data and online crimes have emerged, which the old legal system was not able to cover properly. BNS and BNSS have been created keeping in mind these new crimes and contemporary issues.
  2. Making the legal process faster and transparent:-   In the old process, cases remained pending for long periods of time, justice was delayed and there were problems of corruption in the courts. The main objective of BNS and BNSS is to make the process of justice delivery faster, transparent and effective.
  3. Ability to catch new crimes and criminals: The old laws did not mention many crimes that have become common nowadays, such as cyber crime , hacking, online fraud, etc. BNS and BNSS are designed with special provisions to deal with these crimes.
  4. Social equity and women safety: Crimes against women, such as sexual harassment, domestic violence, women's online safety, etc., were not properly covered in these old laws. BNS and BNSS have special provisions for these issues, which will help in providing better protection and justice to women.

What are the main changes in BNS and BNSS?

  1. Definitions of new crimes:- BNS and BNSS include new crimes which were not previously covered in IPC and CRPC. Specific provisions have been added for crimes like cyber crime, trolling, crimes on social media, online fraud etc. These new crimes have been created keeping in mind our changing world.

  2. Stringent punishments and penalties for criminals: BNS and BNSS have provisions for stringent punishments and penalties for criminals. Especially, stringent punishments have been talked about for those who commit crimes against women and children. Along with this, many new provisions have also simplified the process of speedy execution of punishment for the criminal.

  3. Smart and fast justice process: Many reforms have been made in BNS and BNSS to speed up the justice process. Now the courts have been motivated to work more efficiently. This will enable cases to be heard quickly and without any hindrance. Additionally, this process will be completely transparent, which will curb corruption.

  4. Special protection for women and children: Strict provisions have been made in BNS and BNSS to prevent crimes against women and children. New measures and laws have been implemented to protect women, safeguard their rights, and provide them speedy justice.

  5. Digital and Cyber ​​Security: Cyber ​​crimes are increasing rapidly these days, which include hacking, online fraud, cyber stalking, etc. Special legal provisions have been made for these crimes in BNS and BNSS , which will help in dealing with cyber crimes effectively.

BNS (Bharatiya Nyay Sanhita) and BNSS (Bharatiya Nagrik Suraksha Sahinta ) are important legal reforms in India, which have been implemented in place of the Indian Penal Code (IPC) and the Indian Code of Criminal Procedure (CRPC). These laws were aimed at making the Indian judicial system more effective, transparent and modern, so that it can better address new social and technological changes.

      

The BNS and BNSS were proposed by the Indian government in 2020 , and were a significant step towards updating the Indian Penal Code (IPC) and the Code of Criminal Procedure (CRPC) as part of legal reforms. These laws were aimed at bringing more clarity and reforms to better address contemporary crimes such as cybercrime, online fraud, women's safety, and other digital crimes.


Conclusion:-  BNS and BNSS were introduced to make the Indian justice system more robust and contemporary. These have come into effect from 2024, and their aim is to make the Indian law modern and effective, so that the resolution of crimes in society can be accelerated and people can get better justice.
